Kalle - Wrongful Dismissal Case

There was another, unrelated although comparable, matter that arose during this same time-frame which confirms the arrogant and arbitrary attitude and abilities of Delhi Township. This concerns the wrongful dismissal of Maurice Kalle in 1996. What follows will illustrate Chief Administrative Officer Frank Gelinas and staff Frank Sams and David Anderson to produce falsified government documents and to further conspire to coverup their own negligent misconduct. This was accomplished through the suppression of information from Council, which was a Breach of Trust of their responsibilities to Council and the Public Interest, in respect to their non-compliance with government laws and statutes, as well as the production of falsified and forged documents, conspiracy, misrepresentation and fraud,

In February of 1996, Delhi Township Arena employee Maurice Kalle, was dismissed. Delhi Township Council and staff refused to resolve this incident.

In 1998 Township of Delhi Haldimond-Norfolk Regional Councillor Gary Nichols became involved in this dispute, after receiving a request to look into this matter from constituent Maruice Kalle.

Councillor Nichols’ investigation confirmed that Arena Manager Frank Sams directed Mr. Kalle to operate the Arena Refrigeration Unit [Compressor] which by Ontario Provincial Statutes could only be operated by a certified Operating Engineer. Mr. Kalle did not possess this certification, and refused the work order out of a Public Safety concern.

In the past 7 years, Mrs. Kalle has received no appropriate response to his various attempts to resolve this matter, so that at this point in time, out of utter frustration and in an attempt to find justice, he is now filing documents with the Courts for Criminal Charges for Breach of Trust, conspiracy, misrepresentation and fraud to the following individuals:

Frank Sams
Roger Vermeulen
Thomas Cline

The investigation by Councillor Nichols confirmed that Maurice Kalle had applied February 1, 1996 for full time employment with the Township, with the application signed and approved by Arena Manager, Frank Sams.

The recommendation to hire Mr. Kalle was presented at the Recreation and Community Services Committee meeting of February 6, 1996 and approved by Committee.

On February 7, Mr. Sams directed Mr. Kalle to operate the Arena Refrigeration Unit and Mr. Kalle refused the work order at that time.

Mr. Kalle’s work with the Township was immediately suspended and the work suspension was further confirmed on February 8, when Mr. Sams requested that Mr. Kalle return the keys to the Arena. However the record of the meeting minutes for the Regular Council meeting of February 12, 1997 confirm and indicate a fraudulent deception to Council by staff, when Council voted and accepted the recommendation and approval from the Recreation Committee of February 6, 1996 for the hiring and full time employment of Maurice Kalle 5 days after the staff had suspended his employment.

This in fact, confirms that Mr. Gelinas and Mr. Sams did not inform Council of the fact that Mr. Kalle’s employment with the Township had been suspended in order to keep suppressed the information concerning their negligent misconduct, for if Council had been informed, they would not have proceeded to approve this hiring, this date, after the fact.

Later, when Mr. Kalle brought this dispute to the attention of the Mayor and other Councillors, Mr. Gelinas and Mr. Sams stated that Mr. Kalle had "quit" his employment with the Township.

These statements were also proven to be false in respect to the Ministry of Labour Board hearing of October 6, 1998 and documents presented from Delhi Township files reference Ministry of Labour Form A-72 #43 attachment #9, Omers pension Form 143 A - Type of Event "Termination" date of event 96/02/07.  [Click on icon below]

With this information we have now confirmed the Breach of Trust, conspiracy, deception, misrepresentation and fraud by Mr. Gelinas and staff regarding Mr. Kalle's dispute with the Township, as a comparable to the hearsay evidence provided in court by Mr. Gelinas and Mr. Anderson regarding the "in camera" "Direction" from Council to cease commercial operations with Nichols Gravel Limited, which statement is completely lacking in any supporting documentation or confirming evidence whatsoever, other than the testimony to the event of Mr. Gelinas and Mr. Anderson which testimony we have confirmed to be unreliable, but was accepted without question by the courts.

At completion of Mr. Gelinas' Event #4, there will be a review of the dysfunctional decision on Appeal to Divisional Court, Hamilton, June 3, 1999 by Justices Keenan, Somers and Cumming, to the decision of Justice Corvargan August 23, '96 and immediately thereafter a review of the negligent misconduct to obstruction of Justice of the Ontario Provincial Police and the coverup review and decision of February 12, 2002 by the Ontario Civilian Commission on Police Services.
